Beta Tester Agreement

BETA TESTER AGREEMENT ADDENDUM

This Beta Tester Agreement Addendum (“Addendum”) supplements and forms part of the Website Terms of Use between you (“Tester,” “you”) and TRAVLMATCH, LLC (“Company,” “we,” or “us”). By participating in the beta testing program (the “Beta Program”) and accessing beta versions of our services, features, or products (collectively, the “Beta Services”), you agree to the terms of this Addendum, which shall control in the event of conflict with the Terms of Use.

1. Purpose and Scope

The Company may provide you with early access to Beta Services for the purpose of testing, evaluating, and providing feedback.

  • Users shall be converted to standard non-beta user experience automatically after three (3) weeks or when the beta period ends.
  • The Beta Services may be incomplete, unstable, or contain errors.
  • The Company may add, modify, suspend, or discontinue Beta Services at any time without liability.
  • Access is granted solely for evaluation purposes and does not constitute a commercial release.

2. Eligibility and Participation

  • Participation is voluntary and at the Company’s sole discretion.
  • You represent that you are legally competent to enter this agreement and are not barred from participation by law or regulation.
  • The Company may limit the number of testers or geographic locations where the Beta Program is available.

3. Confidentiality and Non-Disclosure

You may receive access to non-public information. You agree to maintain confidentiality, to use Confidential Information solely for the Beta Program, to avoid screenshots or external discussions unless authorized, and to continue confidentiality obligations after termination.

4. Feedback and Intellectual Property

  • You agree to provide Feedback.
  • All Feedback is the Company’s sole property, assigned without further compensation.
  • The Company may use, disclose, reproduce, or license Feedback for any purpose.

5. Data Collection and Privacy

  • We may collect technical and usage data, including logs and crash reports.
  • Data is used to improve products and processed per our Privacy Policy and applicable law.
  • Participation constitutes consent to this collection and processing.

6. Disclaimers

  • Beta Services are provided “AS IS” and “AS AVAILABLE”.
  • We disclaim all warranties, including merchantability, fitness, accuracy, non-infringement, and uninterrupted service.
  • No guarantee Beta Services will become part of a commercial release.

7. Limitation of Liability

  • To the maximum extent allowed by law, we are not liable for direct or indirect damages related to Beta Services.
  • Your sole remedy is to discontinue participation.
  • Certain limitations may not apply where prohibited by law.

8. Term and Termination

  • Effective for the duration of participation.
  • We may terminate access at any time.
  • Upon termination, cease use, delete materials, and comply with confidentiality.

9. Conversion to General Terms

  • Upon public release, continued use is governed by the general Terms of Use, Privacy Policy, and other applicable agreements.
  • Participation does not guarantee continued access to released products or services.

10. Governing Law and Dispute Resolution

Governed by the same law and dispute provisions in the Website Terms of Use.

11. Entire Agreement

This Addendum, together with the Terms of Use, Privacy Policy, and other documents, constitutes the entire agreement regarding the Beta Program.
